Terms and Conditions

1. Introduction

These terms and conditions govern the provision of landscaping services by Maybury Landscaping ("we", "us", "our") to you ("the customer", "you"). By accepting a quote or commissioning work from us, you agree to be bound by these terms.

2. Quotations

• All quotations are free of charge and provided without obligation.
• Quotations are valid for 30 days from the date of issue unless otherwise stated.
• Quotations are based on the information provided and site conditions observed at the time of survey.
• Any additional work discovered during the project will be quoted separately before proceeding.
• Prices quoted exclude any necessary planning permissions, building warrants, or other statutory approvals unless specifically stated.

3. Payment Terms

• A deposit of 25-50% (depending on project size) is required upon acceptance of the quote to secure your booking.
• For larger projects, staged payments may be agreed based on project milestones.
• Final payment is due upon completion of the work to your satisfaction.
• We accept bank transfer, cash, and major credit/debit cards.
• Late payments may incur interest at 4% above the Bank of England base rate.

4. Project Scheduling

• Start dates are provisional and subject to weather conditions and material availability.
• We will keep you informed of any significant delays.
• Adverse weather may affect project timelines; we will not work in conditions that could compromise quality or safety.
• Estimated completion times are provided in good faith but are not guaranteed.

5. Customer Responsibilities

• Ensure clear access to the work area for our team and delivery vehicles.
• Inform us of any underground utilities, cables, or pipes.
• Obtain any necessary permissions from neighbours or local authorities.
• Ensure pets and children are kept away from the work area during construction.
• Provide access to water and electricity if required for the project.

6. Guarantees and Warranties

• We provide a 10-year workmanship guarantee on all installations.
• Material warranties vary by product and are passed on to you as provided by manufacturers.
• Guarantees do not cover damage caused by misuse, neglect, or third-party interference.
• Natural materials may vary in colour and pattern - this is not a defect.
• Some settling of new installations is normal and not covered under warranty.

7. Variations and Changes

• Any changes to the agreed scope of work must be confirmed in writing.
• Additional work will be quoted separately and agreed before commencement.
• We reserve the right to substitute materials of equivalent or better quality if specified materials are unavailable.

8. Cancellation

• You may cancel within 14 days of accepting a quote for a full deposit refund.
• Cancellations after 14 days may forfeit part or all of the deposit depending on materials ordered.
• Once work has commenced, you will be liable for all work completed and materials purchased.

9. Insurance and Liability

• We hold public liability insurance of £5,000,000.
• We will make good any damage caused by our work, but are not liable for pre-existing defects.
• Our liability is limited to the value of the contracted work.
• We are not liable for damage to underground utilities that were not disclosed to us.

10. Dispute Resolution

In the event of any dispute, we will first attempt to resolve the matter directly with you. If this is not possible, disputes may be referred to mediation or, ultimately, to the Scottish courts, which shall have exclusive jurisdiction.
